LOI ORGANIQUE N° 29/2005 DU 31/12/2005 PORTANT ORGANISATION DES ENTITES ADMINISTRATIVES DE LA REPUBLIQUE DU RWANDA
Nous, KAGAME Paul,
Président de la République ;
LE PARLEMENT A ADOPTE ET NOUS SANCTIONNONS, PROMULGUONS LA LOI ORGANIQUE DONT LA TENEUR SUIT ET ORDONNONS QU’ELLE SOIT PUBLIEE AU JOURNAL OFFICIEL DE LA REPUBLIQUE DU RWANDA.
LE PARLEMENT :
La Chambre des Députés, en sa séance du 2 décembre 2005;
Le Sénat, en sa séance du 20 décembre 2005 ;
Vu la Constitution de la République du Rwanda du 04 juin 2003 telle que révisée à ce jour, spécialement en ses articles 3, 62, 88, 90, 92, 93, 95, 108, 118, 121, 167, et 201 ;
Revu la loi n° 47/2000 du 19/12/2000 modifiant et complétant la loi du 15/04/1963 portant structures de la République du Rwanda telle que modifiée et complétée à ce jour ;
ADOPTE :
CHAPITRE PREMIER : DES DISPOSITIONS GENERALES
Article premier :
La présente loi organique porte création des entités territorales de la République du Rwanda et en fixe le nombre, les limites et la structure.
Article 2 :
Le Rwanda est subdivisé en entités administratives suivantes :
1° Les Provinces et la Ville de Kigali ;
2° Les Districts ;
3° Les Secteurs ;
4° Les Cellules ;
5° Villages.
Article 3 :
Les Provinces et la Ville de Kigali sont subdivisées en Districts.
Le District est subdivisé en Secteurs. Les limites des Secteurs sont fixées par Arrêté Présidentiel sur demande du Ministre ayant l’administration locale dans ses attributions.
Le Secteur est subdivisé en Cellules. Les Cellules sont subdivisées en Villages. Les limites des Cellules et des Villages sont fixées par Arrêté du Ministre ayant l’administration dans ses attributions.








CHAPITRE II : DU NOMBRE ET DES LIMITES DES PROVINCES ET DE LA VILLE DE KIGALI
Article 4 :
Le Rwanda est subdivisé en quatre (4) Provinces et la Ville de Kigali. Les dénominations et les chefs lieu des Provinces et de la Ville de Kigali figurent au tableau ci-après :

Article 5 :
Les limites des Provinces et de la Ville de Kigali se trouvent à l’annexe première (I) de la présente loi organique.
CHAPITRE III : DU NOMBRE ET DES LIMITES DES DISTRICTS
Article 6 :
Les Provinces et la Ville de Kigali sont subdivisées en Districts.
Le nombre, les limites des Districts se trouvent à l’annexe deux (II) de la présente loi organique.
CHAPITRE IV: DE LA STRUCTURE DES PROVINCES, DE LA VILLE DE KIGALI ET DES
DISTRICTS
Article 7 :
La structure de la Province, de la Ville de Kigali et des Districts se trouve à l’annexe trois (III) de la présente loi organique.
CHAPITRE V : DE L’ADMINISTRATION DES ENTITES ADMINISTRATIVES
Article 8 :
L‘administration d’une Province est assurée par un Gouverneur nommé par Arrêté Présidentiel sur approbation du Sénat.
Les autorités des autres entités territoriales sont précisées par les lois particulières régissant ces entités administratives.
CHAPITRE V : DES DISPOSITIONS TRANSITOIRES ET FINALES
Article 9 :
L’Arrêté Présidentiel détermine les modalités d’administration provisoire des Provinces, de la Ville de Kigali, des Districts et des Secteurs en attendant que leurs autorités soient élues ou nommées.
Article 10 :
Toutes les dispositions légales antérieures contraires à la présente loi organique sont abrogées.

Article 11 :
La présente loi organique entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.

ORGANIC LAW Nº 29/2005 OF 31/12/2005 DETERMINING THE ADMINISTRATIVE ENTITIES OF THE REPUBLIC OF RWANDA

We, KAGAME Paul,
President of the Republic;

THE PARLIAMENT HAS ADOPTED AND WE SANCTION, PROMULGATE THE FOLLOWING ORGANIC LAW AND ORDER IT BE PUBLISHED IN THE OFFICIAL GAZETTE OF THE REPUBLIC OF RWANDA

THE PARLIAMENT:

The Chamber of Deputies, in its session of December 2, 2005;
The Senate, in its session of December 20, 2005;
Given the Constitution of the Republic of Rwanda of June 4, 2003, as amended to date, especially in its articles 3, 62, 88, 90, 92, 93, 95, 108, 118, 121, 167 and 201;
Having reviewed law n° 47/2000 of December 19, 2000 amending law of April 15, 1963 concerning the administration of the Republic of Rwanda as amended and complemented to date;
ADOPTS:
CHAPTER ONE: GENERAL PROVISIONS
Article one:
This organic law determines the administrative entities of the Republic of Rwanda and establishes the number, boundaries and their structure.
Article 2:
The Republic of Rwanda is divided into the following administrative entities:
1° Provinces and the City of Kigali;
2° Districts;
3° Sectors;
4° Cells;
5° Villages.
Article 3:
Provinces and the City of Kigali are divided into Districts
A District is divided into Sectors. The boundaries of the cell are determined by the order of the President upon request by the Minister having local government in his or her attributions
A Sector is divided into Cells. Cells are divided into villages.
Boundaries of cells and villages are determined by the order of the Minister having local government in his or her attributions.



CHAPTER II: THE NUMBER, HEAD OFFICE AND BOUNDARIES OF PROVINCES AND THE
CITY OF KIGALI
Article 4:
The Republic of Rwanda is divided into four (4) Provinces and the City of Kigali. The names, number and the head offices of Provinces and of the City of Kigali are indicated in the table below:

Article 5:
The boundaries of Provinces and the City of Kigali are found in annex I of this organic law.
CHAPTER III: THE NUMBER AND BOUNDARIES OF DISTRICTS
Article 6:
Provinces and the City of Kigali are divided into Districts.
The number and boundaries of Districts are found in annex II of this organic law.
CHAPTER IV: THE STRUCTURE OF PROVINCES, CITY OF KIGALI AND DISTRICTS
Article 7:
The structure of Provinces, the City of Kigali and that of Districts are found in annex III of this organic law.
CHAPTER V: ADMINISTRATION OF ENTITIES
Article 8:
The Province is administered by a Governor who is appointed by a Presidential Order upon approval by the Senate.
The administration of other administrative entities of the Republic of Rwanda is determined by particular laws that govern them.
CHAPTER VI: TRANSITIONAL AND FINAL PROVISIONS
Article 9:
A Presidential Order shall determine the provisional modalities of administration of Provinces, City of Kigali, Districts and Sectors during the period when the administrators of such entities are not yet elected or appointed.
Article 10:
All previous legal provisions contrary to this law are hereby abrogated.


Article 11:
This organic law comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.

Akarere kagabanyijemo Imirenge. Imbibi z’Imirenge zigenwa n’Iteka rya Perezida bisabwe na Minisitiri ufite ubutegetsi bw’Igihugu mu nshingano ze.
Umurenge ugabanyijemo Utugari. Utugari tugabanyijemo Imidugudu. Imbibi z’Utugari n’iz’Imidugudu zigenwa n’Iteka rya Minisitiri ufite Ubutegetsi bw’Igihugu mu nshingano ze.
